2026 Extraordinary Migrant Regularisation Guide
General Context:
The Government of Spain has approved an extraordinary regularisation process to integrate thousands of foreign nationals, thereby strengthening the Social Security system and guaranteeing fundamental rights under Royal Decree 316/2026.
1. Eligibility Requirements
- Previous Residence: Must have entered Spain before January 1, 2026.
- Continuous Stay: Must prove a minimum uninterrupted stay of 5 months prior to submitting the application.
- Civic Conduct: Must have no criminal record in Spain or in previous countries of residence.
2. Process and Benefits
- Application Period: Applications are accepted from April 16 to June 30, 2026.
- Immediate Work Permit: A provisional work authorization is granted upon the admission of the application for processing.
- Permit Validity: Residence and work authorization for 1 year (renewable) for adults.
- Path to Citizenship: Residence time for Spanish nationality starts counting from the moment the application is admitted for processing.
3. Submission Methods
- Online (Preferred): Starting April 16, 2026, via the Electronic Office and the UTEX platform.
- In-person: Starting April 20, 2026, at Social Security offices and Post Offices (Correos).
4. National Impact and Key Dates
- Estimated Impact: Approximately 840,000 people are expected to attain legal administrative status.
- Critical Deadlines:
- 01/01: Deadline for entry into Spain to be eligible.
- 16/04: Opening of the application window (online).
- 30/06: Final closing of the regularisation process.
